{"id":2017,"date":"2024-09-24T13:02:27","date_gmt":"2024-09-24T13:02:27","guid":{"rendered":"https:\/\/kaancenkadasoy.com\/?p=2017"},"modified":"2024-10-05T06:06:08","modified_gmt":"2024-10-05T06:06:08","slug":"adalet-arayisi","status":"publish","type":"post","link":"https:\/\/kaancenkadasoy.com\/en\/adalet-arayisi\/","title":{"rendered":"Adalet aray\u0131\u015f\u0131"},"content":{"rendered":"<p>Son y\u0131llarda T\u00fcrkiye\u2019de kamu vicdan\u0131n\u0131 derinden yaralayan olaylar, adalet sistemine dair derin bir sorgulamay\u0131 beraberinde getirdi. \u00d6zellikle Dilan Polat davas\u0131, toplumda adaletin tecelli etmedi\u011fine dair g\u00fc\u00e7l\u00fc bir inan\u00e7 do\u011furdu. Narin ve S\u0131la bebek vakalar\u0131 gibi y\u00fcrek burkan trajediler ise su\u00e7lulara verilen cezalar\u0131n yeterince cayd\u0131r\u0131c\u0131 olmad\u0131\u011f\u0131 y\u00f6n\u00fcndeki ele\u015ftirileri daha da alevlendirdi. A\u011f\u0131r su\u00e7larda daha sert yapt\u0131r\u0131mlar talep eden toplum, \u201c\u0130yi h\u00e2l indirimi\u201d gibi uygulamalar\u0131n h\u00e2l\u00e2 tart\u0131\u015fma konusu olmas\u0131n\u0131 adalet duygusuna bir darbe olarak g\u00f6r\u00fcyor.<\/p>\n\n\n\n<p><strong>\u0130yi h\u00e2l indirimi: Adaleti zay\u0131flat\u0131yor mu?<\/strong><\/p>\n\n\n\n<p>T\u00fcrkiye\u2019de iyi h\u00e2l indirimi, uzun y\u0131llard\u0131r ceza hukukunun \u00f6nemli bir unsuru. Ancak toplumu derinden etkileyen cinsel su\u00e7lar ve kad\u0131n cinayetleri gibi vakalar, bu indirimin b\u00fcy\u00fck tepki toplamas\u0131na yol a\u00e7t\u0131. \u00d6nceki d\u00f6nem y\u00fcr\u00fcrl\u00fc\u011fe giren baz\u0131 yasal d\u00fczenlemelerle, bu t\u00fcr su\u00e7larda iyi h\u00e2l indiriminin s\u0131n\u0131rl\u0131 uygulanmas\u0131 ya da hi\u00e7 uygulanmamas\u0131 y\u00f6n\u00fcnde \u00f6nemli ad\u0131mlar at\u0131ld\u0131. Yine de toplumun geni\u015f kesimi, \u00f6zellikle \u00e7ocuklara kar\u015f\u0131 i\u015flenen su\u00e7larda bu indirimin adaleti yumu\u015fatt\u0131\u011f\u0131na inan\u0131yor. Ma\u011fdur aileleri, katillerin ve sald\u0131rganlar\u0131n ceza indiriminden yararlanarak hak ettiklerinden daha az ceza almas\u0131n\u0131n derin bir haks\u0131zl\u0131k oldu\u011funu ifade ediyor. Bu durum, toplum genelinde adaletin tecelli etmedi\u011fi alg\u0131s\u0131n\u0131 ayn\u0131 oranda g\u00fc\u00e7lendiriyor.<\/p>\n\n\n\n<p><strong>Hibrit yarg\u0131 modeli: Daha adil bir yarg\u0131 m\u00fcmk\u00fcn m\u00fc?<\/strong><\/p>\n\n\n\n<p>Ger\u00e7ek \u015fu ki, adalet sistemi yaln\u0131zca kanunlara de\u011fil, toplumun vicdan\u0131na da hitap etmelidir. Son y\u0131llarda adaletin daha \u015feffaf ve topluma daha yak\u0131n olmas\u0131 gerekti\u011fini savunan kesimler, Anglo-Sakson \u00fclkelerinde uygulanan j\u00fcri sistemine dayal\u0131 bir hibrit yarg\u0131 modelini tart\u0131\u015fmaya a\u00e7t\u0131. \u00d6rne\u011fin ABD ile toplumsal olarak bir\u00e7ok benzerlik ta\u015f\u0131yan T\u00fcrkiye gibi \u00fclkelerde, \u00f6zellikle a\u011f\u0131r su\u00e7lar s\u00f6z konusu oldu\u011funda, halk\u0131n adalet s\u00fcrecine do\u011frudan kat\u0131l\u0131m\u0131n\u0131 sa\u011flayacak hibrit bir sistemin mahkemelerin toplumda daha fazla kabul g\u00f6rmesine yard\u0131mc\u0131 olabilece\u011fi \u00f6ne s\u00fcr\u00fcl\u00fcyor.&nbsp;<\/p>\n\n\n\n<p>Hibrit model, yarg\u0131\u00e7lar\u0131n hukuki bilgisi ile halk\u0131n vicdani de\u011ferlendirmelerini harmanlayarak daha dengeli ve toplum taraf\u0131ndan benimsenen kararlar al\u0131nmas\u0131n\u0131 sa\u011flayabilir.&nbsp;<\/p>\n\n\n\n<p>Ayr\u0131ca bu modelin, yarg\u0131 s\u00fcre\u00e7lerini h\u0131zland\u0131rma potansiyeli de dikkat \u00e7ekiyor. Mahkemelerde biriken davalar\u0131n yaratt\u0131\u011f\u0131 gecikmeler, adaletin ge\u00e7 tecelli etmesine ve yarg\u0131ya olan g\u00fcvenin zay\u0131flamas\u0131na da yol a\u00e7\u0131yor. Halk\u0131n karar alma s\u00fcre\u00e7lerine d\u00e2hil olmas\u0131, dava y\u00fck\u00fcn\u00fc azaltarak adaletin h\u0131zlanmas\u0131na da katk\u0131 sa\u011flayabilir.<\/p>\n\n\n\n<p><strong>KKTC i\u00e7in hibrit yarg\u0131<\/strong><\/p>\n\n\n\n<p>T\u00fcrkiye\u2019de ya\u015fanan adalet tart\u0131\u015fmalar\u0131, KKTC i\u00e7in de \u00f6nemli \u00f6\u011f\u00fctler bar\u0131nd\u0131r\u0131yor. Son y\u0131llarda baz\u0131 su\u00e7lular\u0131n h\u0131zl\u0131 bir \u015fekilde tahliye edilmesi, KKTC&#8217;de de \u201cAdalet yerini buluyor mu?\u201d sorusunu g\u00fcndeme getirdi. Bu ba\u011flamda, hibrit bir yarg\u0131 modelinin KKTC\u2019de uygulanmas\u0131, toplumun adalet s\u00fcre\u00e7lerine olan g\u00fcvenini art\u0131rabilir. Halk\u0131n yarg\u0131lamaya kat\u0131lmas\u0131, kararlar\u0131n daha geni\u015f bir kabul g\u00f6rmesine ve adaletin toplumsal boyutunun g\u00fc\u00e7lenmesine yard\u0131mc\u0131 olabilir.<\/p>\n\n\n\n<p>Tabii KKTC\u2019de yarg\u0131n\u0131n kar\u015f\u0131 kar\u015f\u0131ya oldu\u011fu \u00f6nemli sorunlardan biri de dava s\u00fcre\u00e7lerinin uzamas\u0131 ve yarg\u0131 \u00fczerindeki a\u011f\u0131r i\u015f y\u00fck\u00fcd\u00fcr. Halk\u0131n kat\u0131l\u0131m\u0131yla olu\u015fturulacak bir yarg\u0131 modeli, baz\u0131 davalarda karar s\u00fcre\u00e7lerini yukar\u0131da vurguland\u0131\u011f\u0131 \u00fczere h\u0131zland\u0131rabilir ve Ada\u2019da adaletin daha h\u0131zl\u0131 bir \u015fekilde tecelli etmesini sa\u011flayabilir.&nbsp;<\/p>\n\n\n\n<p>Sonu\u00e7 olarak hibrit yarg\u0131 sistemi, gerek T\u00fcrkiye&#8217;de gerekse KKTC\u2019de, toplumun vicdani kanaatlerinin yarg\u0131 s\u00fcrecine d\u00e2hil edilmesiyle daha adil, \u015feffaf ve toplumsal bar\u0131\u015f\u0131 destekleyen bir adalet anlay\u0131\u015f\u0131 olu\u015fturma ve adalete olan g\u00fcveni yeniden tesis etme potansiyeline sahip en \u00f6nemli ad\u0131mlardan biri olarak kar\u015f\u0131m\u0131zda duruyor.<\/p>\n\n\n\n<p>*****<\/p>\n\n\n\n<p><strong>Adalet, her \u015feyi lay\u0131k oldu\u011fu yere koymakt\u0131r; ayakkab\u0131 aya\u011f\u0131nd\u0131r, k\u00fclah ba\u015f\u0131n.<\/strong><\/p>\n\n\n\n<p><em>Hz.
